Terms and Conditions

Effective September 1, 2026 · Version 2026-09-01-v3

These Terms govern every account, listing, social interaction, live event, offer, purchase, and service made available through Collectible 101. They are written for this marketplace and should be reviewed by qualified counsel before commercial reliance.

1.Agreement and incorporated policies

By creating an account, accessing the service, listing an item, placing a bid, making an offer, purchasing, or otherwise using Collectible 101, you agree to these Terms, the Privacy Policy, Shipping and Returns Policy, Community Standards, transaction-specific disclosures, and any additional terms presented at the point of use. If you do not agree, do not use the service.

2.Eligibility and authority

You must be legally able to enter a binding contract and meet all age, identity, location, sanctions, and payment requirements that apply to the feature you use. If you act for a business, dealer, consignor, or other organization, you represent that you have authority to bind it.

3.Accounts and credentials

Information provided to Collectible 101 must be accurate, current, and complete. You are responsible for safeguarding passwords, access codes, devices, and sessions and for activity conducted through your account. Accounts may not be sold, transferred, shared to evade controls, or used to impersonate another person.

4.Marketplace role

Collectible 101 provides discovery, communication, recordkeeping, social, screening, live-event, shipping-support, and payment-facilitation technology. Except where a listing expressly identifies Collectible 101 as the seller, each independent dealer is the seller of record and bears the seller's legal obligations. Collectible 101 does not take title to dealer inventory merely by displaying or facilitating a transaction.

5.Zero commission model

Collectible 101 charges dealers subscription or separately disclosed service fees and does not take a percentage commission from ordinary dealer sales. The dealer receives the item price through its connected payment account, subject to payment-provider charges, taxes, shipping, insurance, reversals, reserves, and lawful adjustments. A dealer subscription or other service fee does not make Collectible 101 the seller, merchant, guarantor, insurer, or authenticator.

6.Dealer authentication responsibility

Every dealer must inspect and authenticate every item it lists and sells, verify lawful title and authority to sell, and accurately disclose condition, provenance, dimensions, serial or reference information, repairs, restoration, replacement or aftermarket components, grading, certification, and other material facts. Dealer verification is the dealer's representation and warranty; it is not an independent Collectible 101 guarantee.

7.Listings and inventory

Dealers must use accurate photographs and descriptions, maintain availability and pricing, avoid misleading comparisons, and promptly pause unavailable inventory. Listings may not include counterfeit, stolen, unsafe, recalled, prohibited, infringing, illegally imported, sanctioned, or unlawfully obtained goods. Collectible 101 may request documentation, review, restrict, remove, or preserve a listing or related evidence.

8.Binding offers, bids, and purchases

A submitted offer or bid may be binding under the rules shown for that feature. Selecting a purchase action and submitting payment creates a binding agreement with the identified seller for the item price plus disclosed shipping, insurance, tax, duty, and other lawful charges. Inventory, identity, fraud, source availability, and payment checks may occur before capture or fulfillment.

9.Payments

Payments are processed by third-party payment providers and, for ordinary dealer transactions, routed through the dealer's connected merchant account. Users authorize the provider and relevant seller to collect, settle, reverse, refund, or adjust amounts as permitted by the transaction and provider rules. Collectible 101 does not store full payment-card credentials and is not responsible for a provider's independent services.

10.Taxes and reporting

Dealers are responsible for seller tax registrations, reporting, invoices, and obligations except where a payment provider or applicable law expressly assigns collection or remittance elsewhere. Buyers are responsible for duties, import charges, use taxes, and similar amounts not collected at checkout.

11.Shipping, insurance, and delivery

The Shipping and Returns Policy is incorporated into these Terms. Dealers must package appropriately, use the saved delivery address, obtain required tracking, insurance, and signature services, and preserve shipment records. Estimates are not guarantees. Carrier terms and exclusions also apply.

12.Final sale for authentic, conforming items

Except where non-waivable law requires otherwise, a dealer item that is authentic, delivered, and materially conforms to the listing is final sale. Buyer's remorse, fit, preference, changed circumstances, market-price movement, or a disclosed condition does not create a cancellation, return, or refund right.

13.Claims that remain available

Final-sale language does not excuse counterfeit goods, lack of title, non-delivery, material misrepresentation, undisclosed material damage, or other rights that cannot lawfully be waived. The buyer must promptly use the available resolution process, preserve the item and evidence, avoid alteration or transfer, and cooperate with reasonable examination and return requirements.

14.Disputes, chargebacks, and evidence

Users must first provide complete and truthful information through the applicable dealer, support, report, dispute, payment-provider, or insurer process. Collectible 101 may preserve and provide legally appropriate records including consent versions and timestamps, listing snapshots, messages, payment references, tracking, delivery events, authentication materials, device information, and audit history. Duplicate recovery, false claims, evidence manipulation, or chargeback abuse is prohibited.

15.Social and live features

Posts, comments, messages, circles, streams, bids, giveaways, profiles, and other community features must comply with the Community Standards and applicable law. Live content may be delayed, interrupted, moderated, archived, or removed. Users remain responsible for their statements, conduct, offers, and transactions.

16.User content license

You retain ownership of content you submit. You grant Collectible 101 a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, moderate, and use that content as reasonably necessary to operate, secure, improve, promote, and evidence the service. You represent that you have all required rights and permissions.

17.Automated marketplace tools

Automated search, recommendations, risk signals, estimates, screening, image generation, summaries, moderation, and authenticity-support tools may be incomplete or incorrect. They are decision-support tools, not professional authentication, appraisal, legal, tax, insurance, investment, or financial advice. Dealers remain responsible for authentication and listing accuracy; users must independently assess material decisions.

18.Prohibited conduct

You may not commit fraud; manipulate bids, reviews, giveaways, pricing, traffic, identity, evidence, or platform metrics; scrape or access the service without authorization; bypass security or rate limits; introduce malicious code; reverse engineer protected portions except where law permits; harass others; infringe rights; transact off-platform to evade obligations; or use the service for unlawful activity.

19.Platform enforcement

Collectible 101 may investigate, request information, limit reach, pause payments where lawful, hold or preserve records, remove content, suspend features, terminate access, notify affected parties, cooperate with providers or authorities, and take proportionate protective action. Enforcement decisions do not create a duty to detect every violation.

20.Intellectual property

Collectible 101's names, marks, interface, visual assets, compilations, documentation, and proprietary technology are protected by applicable law. No license is granted except the limited right to use the service under these Terms. Reports of infringement must identify the work, disputed material, authority to act, and accurate contact information.

21.Master catalog, sourcing, and negotiations

Master-product records organize common collectible references and dealer inventory but do not constitute a warranty that every specimen is identical, authentic, available, or correctly attributed. Custom sourcing requests, buyer-supplied photographs, digitally generated reference imagery, dealer briefs, price requests, parallel offers, private listings, counteroffers, and negotiation histories are transaction-support records. A generated image is illustrative and cannot replace inspection of the actual item. No deal becomes a completed order merely because parties negotiate or a dealer submits an offer; the applicable checkout, payment, availability, and acceptance steps control.

22.Memberships, dealer subscriptions, and recurring charges

Paid customer memberships and dealer subscriptions provide the features stated for the selected tier. Recurring charges, billing intervals, renewals, upgrades, downgrades, cancellations, past-due status, and effective dates are governed by the checkout disclosure and payment-provider authorization. Fees already earned may be nonrefundable except where law or an express written term requires otherwise. Cancellation stops future renewal according to the stated effective date and does not rescind completed transactions or accrued obligations.

23.Reputation, badges, and verification signals

Badges, authentication pass rates, dealer or buyer trust profiles, endorsements, activity metrics, market estimates, ranking, and other reputation signals are contextual platform information, not licensure, fiduciary advice, insurance, certification, or a guarantee of future conduct. Users must not misstate the meaning, scope, or currency of any badge or score.

24.Electronic communications, signatures, and records

You consent to transact electronically and to receive agreements, disclosures, invoices, receipts, notices, policy updates, shipping events, security alerts, and other legally permissible communications through the service or supplied contact channels. A checkbox, button, one-time code, authenticated action, electronic signature, timestamp, document version, cryptographic digest, account reference, device record, or comparable reliable process may constitute an electronic record and signature to the extent permitted by law. You are responsible for retaining copies and keeping contact information current.

25.Permanent and evidentiary records

Certain equity-ledger, legal-acceptance, payment, ownership, provenance, authentication, dispute, moderation, security, and audit events are maintained as append-only or otherwise durable evidence. Correction may occur through a supplemental record rather than deletion or alteration of the original event. You may not falsify, backdate, erase, obscure, or induce another person to manipulate a record relevant to ownership, authenticity, payment, safety, or legal compliance.

26.Notices and opportunity to cure

Notices may be delivered through the account, service interface, email, or another lawful method using the information associated with the account. Unless immediate action is reasonably necessary for safety, fraud prevention, legal compliance, evidence preservation, payment risk, or protection of others, Collectible 101 may provide an opportunity to cure a remediable breach; no course of dealing or delayed enforcement waives any right.

27.Third-party services

The service may link to or embed payment processors, carriers, insurers, video hosts, identity services, maps, analytics, communications providers, and other third parties. Their terms and privacy practices govern their services. Collectible 101 does not control and is not responsible for their availability, content, security, underwriting, settlement decisions, delivery performance, or independent acts.

28.Disclaimers

To the maximum extent permitted by law, the service is provided as available and without implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, market value, investment performance, seller conduct, or item authenticity. Nothing in this section excludes an express dealer warranty or a right that cannot lawfully be excluded.

29.Limitation of liability

To the maximum extent permitted by law, Collectible 101 and its affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, lost profit, lost data, market movement, reputational harm, or acts of buyers, dealers, carriers, insurers, payment providers, or other third parties. Any limitation applies only to the extent lawful and does not limit liability that cannot be limited.

30.Indemnity

You will defend, indemnify, and hold Collectible 101 and its affiliates harmless from third-party claims, losses, penalties, and reasonable costs arising from your content, listing, item, business, breach, fraud, negligence, infringement, unlawful conduct, tax obligation, or misuse of the service, to the extent permitted by law.

31.Governing law and venue

New York law governs these Terms without regard to conflict-of-law rules. Unless mandatory law requires another forum, claims must be brought in the state or federal courts located in New York County, New York. Non-waivable consumer protections remain in effect.

32.Changes, severability, and survival

Material changes will be identified by a new effective date and, where required, additional notice or consent. If one provision is unenforceable, the remainder continues to apply. Provisions concerning payments, ownership, evidence, disputes, disclaimers, liability, indemnity, and accrued rights survive termination.

33.Definitions and interpretation

In these Terms, “Collectible 101,” “platform,” “service,” “we,” “us,” and “our” refer to the operator of the Collectible 101 service; “user” includes visitors, buyers, dealers, consignors, bidders, stream participants, members, and account holders; “dealer” means an independent seller; “item” includes watches, jewelry, bags, cards, apparel, art, and other collectibles; and “transaction” includes a purchase, accepted offer, auction result, subscription, consignment, sourcing request, or other paid activity. Headings are for convenience, the singular includes the plural, “including” means including without limitation, and electronic records satisfy writing requirements where lawful.

34.No agency, partnership, fiduciary, or advisory relationship

Use of the service does not create an employment, franchise, joint venture, partnership, agency, brokerage, fiduciary, escrow, trustee, investment-adviser, appraiser, authenticator, insurer, or attorney-client relationship with Collectible 101. No user may bind Collectible 101, make warranties on its behalf, or represent that Collectible 101 sponsors, certifies, owns, or guarantees an item, user, price, transaction, or outcome unless an authorized written statement expressly says so.

35.Independent decisions and assumption of ordinary marketplace risk

Collectibles involve subjective condition judgments, authenticity questions, incomplete provenance, counterfeit risk, restoration, aftermarket parts, grading differences, illiquidity, price volatility, transport risk, and changing legal or tax treatment. Users must conduct their own diligence, obtain independent professional advice when appropriate, and decide whether a transaction is suitable. To the maximum extent permitted by law, users assume the ordinary risks inherent in collectible ownership and peer-to-peer or dealer transactions that are not caused by Collectible 101’s breach of a non-waivable duty.

36.No appraisal or investment promise

Displayed prices, comparisons, sales histories, estimates, trend indicators, rarity descriptions, demand signals, portfolio values, and potential returns are informational approximations. They may rely on incomplete, delayed, third-party, user-supplied, modeled, or non-comparable data. Collectible 101 does not promise liquidity, resale value, price appreciation, investment performance, tax treatment, or the availability of a buyer, and no content is an offer or recommendation to acquire a security or investment product.

37.Authentication limitations

Authentication may involve dealer review, documents, photographs, automated signals, databases, third-party opinions, or physical inspection, depending on the transaction. No method eliminates error, concealment, future tampering, switched components, forged documents, or disagreement among experts. Unless Collectible 101 separately signs an express written guarantee identifying its scope and remedy, platform labels, intake checks, badges, risk scores, and records do not constitute an unconditional warranty by Collectible 101.

38.Availability, errors, and transaction correction

Listings, inventory, event schedules, bids, prices, taxes, shipping quotes, images, specifications, and catalog associations may contain errors or become unavailable. Collectible 101 may correct clerical or technical errors, cancel duplicate or impossible transactions, reverse clearly erroneous platform entries, or require reconfirmation before fulfillment, subject to applicable law. No automated acknowledgement guarantees acceptance, stock, payment settlement, shipment, or delivery.

39.Communications between users

Collectible 101 is not responsible for promises, representations, advice, conduct, attachments, links, or arrangements made by users in posts, streams, calls, or messages. Users must verify counterparties and keep material transaction terms in the platform record. Collectible 101 may monitor or review communications when permitted for safety, fraud prevention, support, disputes, and legal compliance, but has no general duty to monitor every communication.

40.Off-platform dealings

A user who moves payment, shipping, negotiation, or performance outside the service may lose platform records, controls, notifications, and assistance. Collectible 101 is not responsible for off-platform payments, side agreements, wire instructions, redirects, impersonation, or losses arising from a user’s decision to bypass the recorded transaction process. Users must independently verify any changed payment or delivery instruction through a trusted channel.

41.Service availability and technology

The service may be unavailable, delayed, inaccurate, interrupted, corrupted, or changed because of maintenance, traffic, internet or mobile networks, devices, software, hosting, cyber events, third-party providers, force majeure, or other causes. Collectible 101 does not guarantee uninterrupted access, preservation of every draft, compatibility with every device, error-free operation, or that notifications arrive before an event. Users are responsible for connectivity, compatible equipment, backups of their own records, and confirming time-sensitive actions.

42.Cybersecurity and fraud warnings

No security measure can eliminate phishing, malware, credential theft, account takeover, social engineering, spoofed communications, or unauthorized device access. Users must inspect URLs, protect credentials and one-time codes, enable available safeguards, confirm unusual payment instructions, and promptly report suspected compromise. Collectible 101 is not responsible for loss caused by a user’s disclosure of credentials, compromised device, ignored warning, or unauthorized third-party communication, except to the extent caused by Collectible 101’s breach of a duty that cannot lawfully be excluded.

43.Third-party content and links

References, embeds, advertisements, maps, videos, pricing sources, dealer sites, social profiles, and external links are provided for convenience and do not imply endorsement. Collectible 101 does not control or warrant third-party content, products, availability, privacy, security, legality, accuracy, or performance. Accessing a third-party service is at the user’s discretion and subject to that provider’s terms.

44.Beta, preview, and experimental features

Features identified as beta, preview, generated, estimated, experimental, or early access may be incomplete, change without notice, produce unexpected results, or be withdrawn. They are provided for evaluation and should not be relied on as the sole basis for authentication, valuation, compliance, payment, shipment, safety, or other material decisions.

45.Suspension and termination

A user may stop using the service, but accrued payment, shipment, evidence, claim, indemnity, and legal obligations continue. Collectible 101 may suspend, restrict, or terminate access where reasonably necessary for breach, risk, fraud, abuse, legal compliance, nonpayment, security, or protection of the service or others. Termination does not require deletion of records that may lawfully be retained for transactions, disputes, safety, fraud prevention, taxes, or compliance.

46.Force majeure

To the maximum extent permitted by law, Collectible 101 is not responsible for delay or failure caused by events beyond its reasonable control, including natural disaster, severe weather, fire, epidemic, war, terrorism, civil disorder, labor disruption, carrier interruption, utility or network failure, cyberattack, governmental action, sanctions, embargo, customs action, supplier failure, or payment-provider outage. Deadlines may be reasonably extended while the event continues.

47.Release regarding other users and third parties

To the maximum extent permitted by law, users release Collectible 101 and its affiliates from claims arising solely from disputes between users or from independent acts or omissions of dealers, buyers, carriers, insurers, payment providers, authenticators, hosts, or other third parties. This release does not apply to Collectible 101’s own fraud, willful misconduct, gross negligence where not waivable, or any liability that applicable law prohibits the parties from excluding.

48.Liability cap

To the maximum extent permitted by law, Collectible 101’s aggregate liability arising from a claim will not exceed the greater of the fees paid directly to Collectible 101 by the claimant for the service giving rise to the claim during the twelve months preceding the event or one hundred United States dollars. This cap does not apply where prohibited by law and does not alter an independent dealer’s obligations as seller of record.

49.Time to bring claims

To the extent permitted by law, a claim against Collectible 101 must be commenced within one year after the claimant knew or reasonably should have known of the facts giving rise to it, or it is permanently barred. Transaction, carrier, insurer, payment-provider, and consumer-law deadlines may be shorter or longer and remain independently applicable.

50.Entire agreement; assignment; waiver

These Terms and incorporated policies are the entire agreement concerning the service and supersede prior discussions on the same subject, except a signed transaction-specific agreement. Users may not assign rights or obligations without written consent; Collectible 101 may assign the agreement in connection with a merger, financing, reorganization, or transfer of the service. A failure to enforce a provision is not a waiver, and remedies are cumulative unless expressly stated otherwise.
